Human Rights Action Welcomes Decision of the Constitutional Court of Montenegro to Publish List of Constitutional Appeals.
Human Rights Action (HRA) welcomes the decision of the Constitutional Court of Montenegro to publish a list of 241 constitutional appeals from 2024 on which the Court will rule by the end of June.
The list of constitutional appeals – which includes the initials of the applicants and information on the type of act being challenged – is available on the Court’s website.
In addition to the listed appeals, it was announced that the Constitutional Court will also rule on constitutional appeals related to detention, which are always treated as a priority and which arrive at the Court on a daily basis.
The Constitutional Court announced that the decision was made at the initiative of HRA.
HRA first proposed the publication of such a list and a case resolution plan back in 2014, when the Court was presided over by Desanka Lopičić.
With today’s decision, the Constitutional Court is making a significant step towards the citizens, who often await a ruling on their constitutional appeal after years of court proceedings. By making its work programme publicly available, the Court has significantly increased its transparency and accountability, allowing citizens and legal professionals alike to follow and anticipate the Court’s activity.
It turns out that this important step required nothing more than a little more goodwill.
HRA also reminds that the Constitutional Court recently published a list of 349 regulations in respect of which initiatives and proposals for constitutional and legal review have been submitted to the Court. Together, these two publications mark a meaningful shift towards greater openness in the Court’s operations.
