31/1/2018 DJUROVIC CASE: BASIC COURT IN PODGORICA TO DECIDE URGENTLY ON INJUNCTION REQUEST

Lawyer Dalibor Tomovic, representing Goran Djurovic in the lawsuit against the Parliament of Montenegro due to Djurovic’s illegal dismissal as a member of the Montenegrin National Public Broadcaster’s Council, filed an urgent appeal to the Basic Court in Podgorica to suspend implementation of the Parliament’s decision on dismissal until final court judgment.

The complaint against the state of Montenegro – the Parliament of Montenegro, requesting the court to annul the decision of the Parliament on the Djurovic dismissal, was submitted on 25 January 2018, along with the injunction request.

In the urgent appeal it was emphasized that the nature of the and possible irreparable consequences require an urgent decision on injunction request, due to the fact the Parliament in the meantime announced a competition for the selection of a new member of the Council instead of Djurovic, according to which the deadline for submitting documentation for the election of candidate for the new Council member expires on 13 February when the Parliament will select among the candidates according to specified criteria.

In this case, only the timely decision of the court could provide effective legal protection, and therefore we expect the court to urgently decide on injunction request as well as on the subject of the lawsuit.
